There's a confusion over what hate crime means. Calling someone a Chinky isn't a crime in itself, but if you commit a crime (like an assault) while doing so then you'rre commiting a hate crime. It's a kicker and it doesn't really matter whether or not the guy is Asian or not. Only that he thought he was and the crime was motivated by it. So the officer is actually wrong here, just because he's white doesn't mean it isn't racial abuse from a legal standpoint. |
