"I was joking" is never a defence in itself but you are still allowed to joke about things even very serious things. The key point is that it should be reasonably expected people know it's a joke (which doesn't exist in your gun example but does here) and more importantly even if people take it seriously the consequences of that shouldn't matter (they're very serious in your gun example while here it's just some idiot getting upset online about someone who isn't actually selling remains).
You can quote all the law you want at me but cunts are still allowed to make jokes about illegal things. The specifics do matter and in the specifics of this case no lawyer in their right mind would consider even approaching prosecution over a clear joke. Only a fucking madman would even think it's possible charges could occur here based on this post alone. |
