If the leak is still coming through and the owner above hasn't explored all avenues in terms of identifying the source of the leak, then you can get Environmental Health involved. They've got the powers to ensure owners carry out required repairs and they can serve notice on individuals if required.

Before you get to that stage though, I'd speak to them directly and explain that's it's still coming through and ask that they get the pipes under the floor checked. They might not want to pay for it now, but it's going to cost a hell of a lot more further down the line if they don't nip it in the bud. If they refuse then I'd get Environmental Health involved.

Also worth notifying your insurer straight away as well, even if it's still on going, just so they can make a note on their systems to expect a claim
