Well, from an insurance perspective, u may need to arrange trace and access with ur insurer. If there's no obvious sign of a leak coming from the property upstairs, the onus falls on you to evidence where the leak is coming from. The bad news is, even if the leak originates from ur neighbours property, any damage done to ur property isnt covered by ur neighbours insurance (unless u can evidence that ur neighbour has been negligent - which is almost impossible to prove).

So, in essence, you will need to submit s claim to ur insurer. Technically, even if u dont claim, u still need to notify them of the incident.
