I'm just having a read of their emergency contacts page just now and as you say, it states 'Where a repair is subsequently found to be private in nature, home owners will be jointly liable for all labour and material costs incurred up until the point of identification. Thereafter, the costs of any private repairs instructed will be the responsibility of the individual home owner'. That all makes sense to me.

Therefore, the problem lies with the original reporting of the call as the owner has reported it as a communal issue, deliberately or mistakenly and as such the above terms and conditions have kicked in meaning that any cost up until the problem identified is split between all the owners.

What I think you need to do, is find out from the contractors what their inspection actually entailed, because if they got there and the owner cleared up the misunderstanding and clarified that it was a problem within their flat and the inspection took place within their flat, then I would argue you're not liable for a share of the cost.

On the other hand, if the contractors got there and spent half an hour, an hour, or longer looking at communal parts of the building for the source of the problem, then even though it was reported incorrectly, you'd be liable for that charge as per the T&C's on the website regarding out of hours calls.
