At a guess (having not watched any of the videos for my own sanity, so only based on other people's descriptions) I would say it's likely to be Section 38 of the Criminal and Justice Act (Scotland) 2010:

From a legal point of view, the procurator fiscal may decide to prosecute on the basis that it is a pattern of behaviour that has been repeated and is likely to continue, and so it is in the public interest to prosecute, separate from any possible personal suits. |
