Well I don't know the intricacies specific to this hate crime bill, traditionally hate crime has been a modifier or kicker to an existing crime.

I.E: Harassment, Assault, Murder, ect

You can get done for harassment, but if you do it while yelling racist or sectarian insults then you'll get done with harassment (hate crime) essentially.

I know there have been a few exceptions to this that have made hate crime a specific crime in a few instances such as in the case of harassment, but typically it's not the speech that's the issue. It's the motive that's the problem.

Harassing or attacking someone based on their skin colour, gender, sexual orientation, religion, heritage or such represents a danger to society since the law typically has to think of the 'three rs'. Removal, rehabilitation and retribution. People who represent dangers to society need to be removed. People who lose their temper due to being provoked aren't necessarily a danger, but people who attack or harass people for no good reason are.
