Yeah it can be legally sold. The problem for the buyer is the bank might not approve a mortgage on said property.

I had look at a ground floor flat where the owner had converted the basement, but planning permission had been denied because the stairs to the basement were literally worse than what you see in the traditional buildings in Amsterdam. They sold it to cash buyer instead of someone having to get a mortgage.
