I’m looking at new windows at the moment. Spoke to the Window Advice Centre - they follow the rules, which say if you’re replacing a window, even a modern UPVC one, it needs to be replaced with a sash. There are UPVC sashes that comply. They’re about £1k a window, compared to £2k for timber.

You will be able to find a window company that don’t care and will change it for similar modern unit easily. If the council found out they would make you change it but it’s unlikely they would find out. It might even be possible to repair the existing unit. If it’s just the glass, it can be changed really easily for about £300.

Window Advice Centre were quite good to talk to - if you give them the postcode they can tell you the exact rules in the area. They source quotes for your work from various installers and then check the job has been done properly before you pay. Not used them yet but have asked around and only heard good reviews.
