The response in this instance was proportionate, he didn't have any allies, he could argue that opportunity to escape was limited as the aggressor kept chasing him. He also didn't hit him again after dropping him. This was about as clean a self defence act as you can imagine.
Bear in mind, the tests for self defence are stricter if you use a weapon, especially a bladed weapon. If you punch a guy, and he dies, you can't argue that you didn't know he would die, the egg shell skull rule. However, if the aggressor is the one suffering from the eggshell skull, then his wilful recklessness needs to be taken into account. |
