If there is no will, it is my understanding that her children are legally entitled to claim 50% of the estate. If she was not married to her partner, they would have to fight an up hill legal battle to even try to gain any money. The other 50% of the estate would be available to her children if there's nowhere else for the money to go - i.e, another party, debt payments, etc.

You should absolutely seek legal advice, because what has happened is illegal. And if there was any estate tax to be paid, well.. HMRC will not be happy with her partners actions either.
