It would have to be absurdly clear and you would need to be relying on the motorist basically admitting to it. “Sorry I thought I saw a child running for the road and had to break” all the motorist would need to say and unless he was actively yelling or gesturing at the motorcycle it would be impossible to prove he wasn’t.
