My missis has just applied for the 5 yr leave to remain visa - thats the third application in 5 yrs and if all goes well will be the last. The initial visa (as others have said) is applied for whilst in Canada. It took 3 months. We had been married for 20 yrs at that point and have two kids. Apparently she was more dangerous than a Somalian pirate with no passport, but thats another story. It costs 1,000’s for each application. When we moved back to Scotland from Asia, she used to just get a 6 month stamp every so often, as she still travelled to Asia for her business. She was eventually pulled and told to apply for the visa or be banned. The fact she had kids, property, husband etc and had broken no laws was irrelevant. If you are in it for the long term in your relationship then make sure you keep proof of how u met, being together, etc. Looking at other posts, the under 30, 2 yr right to work looks like your best / easiest bet. Just FYI - my mate in London met a Canadian lassie. She was getting kicked out and so they got married and just went for it. That was a few years ago and now they have kids. Don’t be afraid to chase what you want. Good luck - the whole system / process is a pain in the ass if you want to be legal, no doubt about it.
