Entrapment isn't a crime, it is a discouraged police practice which can be used as a defence in court, i.e. I would not have otherwise committed the crime if they didn't force me to. Presenting the opportunity for someone to commit a crime is not entrapment because the expectation under the law is that a reasonable person would not break the law if given the opportunity to do so, whereas entrapment comes into play in which you would not have normally broken the law except for being forced, intimidated, harassed, or otherwise made to do so by the police |
