Sorry for any misunderstanding but what I meant was that a pedestrian cannot be classed as reckless simply for making a mistake.

Driving too fast and not leaving enough time to stop when there are many pedestrians around in a city centre is reckless. It's an offence commonly referred to as reckless driving although legally described as dangerous driving. The penalty for doing so and killing someone is potentially a life sentence. It is not an offence for a pedestrian to mistakenly walk in the path of a motor vehicle. In reality it is quite easy to do so as vehicles speed and appear out of nowhere at times whilst someone is crossing a road at only 3mph compared to 30mph or more from cars.

The driver who killed the student on Newton Street has learned this the hard way by being arrested at the scene.
