However that only applies (as for all murder) if there is actual intent, and would only apply in the case where the mother survives and the foetus doesn't
There is a current campaign for a similar charge in Scotland as there have been (a small number of) cases where harm has been caused in order to effect a miscarriage, but was only charged as assault on the mother |
