I think that to "swap" a tenant requires the LL's agreement, so if they insist on a new contract instead you might just be out of luck. Is the new price they are asking in line with the current range for the area? You guys might be better off just moving - although I appreciate the person already living in the flat might not want to pack everything up and leave.
