I'm a smoker. I wouldn't smoke in the shelter. Very rarely I've done so if it's been pishing down, but only if the shelter was empty, and if anyone came in I'd move. You wouldn't have been the dick for asking him to move outside a bit further away. No chance of knowing how he would've reacted though.
