Legally this is not true. Civilians can legally be killed in war as collateral damage. This is not necessarily a warcrime as long as it is "proportionate" and the intended target is not civilian in nature. What is proportionate is difficult to quantify. Also much of warcrime legislation criminalises the actions of opposing forces basing themselves amongst the populace, failing to evacuate civilians from the areas in which they operate etc. |
