In essence that really should be the case and enshrined in law.

Unlike other European countries the UK has no strict liability in place to protect more vulnerable road users like pedestrians and cyclists. Hopefully however this will change.

I know this is isn’t good reading for car drivers but a basic description of the said liability is as follows:

“Presumed liability in civil law is the proper approach for a mature, socially conscious nation as it addresses the unacceptable human cost of the current system. Under presumed liability, injured vulnerable road users are properly and promptly cared for and not forced to fight for compensation.”

Reducing speed limits and more use of the vehicles brakes will go a long way to protect you from presumed liability when it becomes law.
