You are correct, I am a police officer and it's not illegal to have something like a baseball bat in your house for the express purpose of defending yourself. There is no legislation outlawing this. You have to show you used it reasonably, which in a break in situation will usually be a pretty forgiving definition. However in basically all circumstances if you seriously injure someone, IE knock them unconscious, give them a permanent disfigurement, disability, or kill them, you will be arrested and interviewed under caution. You now essentially have to be arrested in Scotland in order to be interviewed under caution, as this is the only way to get ensure you can receive free legal advice from a lawyer, which you will always want in this situation. Most likely the circumstances will be reported to the procurator fiscal for them to make a determination.
