| Comment | You can't just say "a fight", unless this hypothetical case has no witnesses and no character references. There's more to a fight than somebody just getting hit and banging their head and dying.
Guy I went to school with got drunk, went for a swim in the sea and drowned. Did the council get sued for not having a secure fence right along the beach? Of course not, because things that are dangerous are pretty clear, so it should be obvious to not do them. The fencing at this site, and the signs on it, should have been enough for anybody with any sense to stay away. Somebody going out of their way to do what they've been told not to (by the signs and the fence) is responsible for whatever happens. If I went climbing up on my neighbour's roof right now, and fell off, you think it'd be their fault for not securing their roof? What's the difference? |
