Hello

I’m a student in Glasgow renting with a certain agency in an HMO property with friends. We’re leaving the flat at the end of august.

Our time renting with our agency hasn't been great. Issues include them taking over a month to provide me with a bed frame - meanwhile they were fully aware that I was sleeping on a mattress on the floor. I could list more minor issues but I’ll hold back on the rant for the sake of your time and my blood pressure. Ultimately I would happily overlook these issues - we have been living in a pandemic after all - however of my 12 months spent in the flat, at least 5 of those involved the agency knowingly violating the HMO agreement: they failed to dispose of refuse which blocked the corridors. The refuse was their responsibility to clear up. They finally cleared it up after the flat had a visit from the fire department who commented on it (checking on a potential gas leak from the neighbours) and when I threatened to contact Shelter Scotland about the issue.

This has just culminated in a bunch of resentment from our end, but we’ve sat on it since we were too lazy to report them or anything. We just wanted stuff replaced and fixed when necessary, we didn’t feel the need to go ahead and take the HMO violation issue further.

Now that we’re leaving the flat we suspect that we might have some issues getting our deposit back in full (mainly due to the fact that our kitchen is carpeted). I’m looking for advice as to how we could approach this. Is there a way that I could propose that we’ll keep quiet on the HMO violation as long as they return the full deposit? Or is that corrupt? Are we overreacting here/ being entitled?

I’ll probably email Shelter Scotland for their advice here but I’m concerned about wasting their time. The deposit is with an approved deposit scheme. Also I have email records which show that they knew that they were violating the HMO agreement.
