Hi all! I'm facing some trouble trying to rent a flat as a newish Glasgow resident and would like to ask for advice.

My wife and I are currently staying in University halls (I'm a postgrad student), and since we're planning to stay in the city after I finish my course, we went out looking for flats to rent, found one that suits us and applied for it.

Apparently all was going relatively well, but the letting agent started insisting that there should be no more than a week of overlap between our current lease contract (with the University) and the one we're going to take, and asked us to provide proof that we have given the University halls notice to leave. In theory, our current contract ends on 8th September and the move-in date for the new flat would be no later than 25th July, giving us about 40 days of overlap.

The thing is that we've already paid for the whole contracted period in the University halls, so there would be no overlap of fees for us. From the move-in date, we would just be paying fees related to the new flat, regardless of having actually moved in or not. Additionally, this overlap period would help us plan better, buy proper furniture for the new place, etc., and on the other hand giving the University notice to leave before having secured another place would be complete nonsense to say the least.

So my question is if the letting agent's demand has any legal root, or is this just an internal rule that they're trying to force upon us? What can I do about this besides insisting with them, and where can I inform myself better about my rights as a prospective tenant?
