  • Have you tried the antisocial behaviour and noise service at the council? https://www.glasgow.gov.uk/article/23575/Antisocial-Behaviour-Noise-Service by dandee95 (Fri 13th Sep 2019 5:40pm)
  • Yeah this has been a massive problem in Glasgow (and other local authorities) for years, but I think you are slightly confused about the nature of the legal action shelter is proposing to take. Previously action by organisations such as Govan Law Centre, Legal Service Agency and Shelter Scotland has been on the basis of individual cases of homeless applicants who have been denied temp accommodation. As you say the procedure in individual cases is to ask the council to provide temp accommodation , threatened JR if not provided and then usually the council roll over. The problem with this approach is that once the council provide temp accommodation to the individual applicant there is no longer a basis on which a JR can be launched as the council has fulfilled thier legal duties to that individual. Therefore no further legal action can be taken against the council, hence why the council roll over so quickly when threatened. The problem is: a) individual should be forced to seek help from a third party to access thier legal rights (which often means they have to resort to rough sleeping until the action is resolved) and b) what about the individuals who are not approaching these organisations help for what ever reason. What this particular action is seeking to do is to challenge the council on a systemic level rather than individual level and is not based on an individual case but evidence of a large number of cases. Effectively shelter are trying to get the court to declare that GCC are routinely breaking the law, and require them to take some steps to address this on a systematic level. This type of action hasn't been raised before against any local authority in Soctland. But of course the meantime Govan Law Centre, Legal Services Agency and Shelter Scotland will continue the vital work of challanging GCC on individual cases. by dandee95 (Wed 2nd Oct 2019 6:38pm)
  • Get in touch with Shelter Scotland's free helpline (0808 800 4444) for advice and support in dealing with the council's homelessness team. by dandee95 (Wed 4th Nov 2020 1:23pm)

  • I also recommend having a chat with Shelter Scotland as they'll be able to give you advice about your rights/ drafting your complaint by dandee95 (Sun 17th Jan 2021 9:49pm)
  • They sound truely horrible. While it might not help with your immediate issues with them I would definitely recommend complaining about them breaching the [letting agent code of practice](http://scotland.shelter.org.uk/get_advice/advice_topics/complaints_and_court_action/making_complaints/complaining_about_a_letting_agency#:~:text=The%20Letting%20Agent%20Code%20of%20Practice&text=Carry%20out%20their%20business%20in,a%20clear%20and%20accessible%20way.&text=Not%20to%20provide%20information%20that%20is%20deliberately%20or%20negligently%20misleading%20or%20false): If you are unsatisfied with their response you can tell take into the First Tier Tribunal (Housing and Property Chamber) and they can sanction the letting agent if they are found to be in breach. It's a long process, which puts a lot of people off, but that's probably what letting agents are banking on. by dandee95 (Sun 17th Jan 2021 9:48pm)
