Interests:

  • Burnside is quiet, depends what you’re looking for. It is a dry area, so no pubs except the Burnside Hotel and the Old Oak which is at the eastfield/Cambuslang side. Ok shops. Houses are decent size but can be expensive. Only Stonelaw road has a few tenement-style flats.   • Is the intercom entry system in your flat mentioned on the inventory? If it is, surely that would fall under a fixture/fitting provided by him and must be in proper working order. You are after all paying for it. If he’s doing nothing about it, you should at least request to have the inventory documents updated appropriately. Just because he told you something after you signed does not mean you cannot have your inventory updated to reflect non-working fixture/fitting.   • Flat I own is GHA tenement which has a block buildings insurance policy with Ageas. The excess is a bit high but that’s GHA/YourPlace’s fault. £350 for water damage - not great if your upstairs neighbour keeps flooding her fking bathroom...The premium is about £120 for buildings insurance. by happyfeet2039 (Mon 26th Aug 2019 7:13pm)
  • Have a round of golf at Linn park before the close it. If you like running you can get from Croftfoot via Linn Park and trails up into Busby along the river. Also up via the woods at Castlemilk on the other side of Spittal. Cathkin Braes is nice for a walk, also running and mountain biking.   • Bit rough but depends where your flat is. The high flats or the tenements on the Main Street? Or the area behind the station (around Wellshot etc). The pubs are a bit feral at times, and Halfway is terrifying. Is your commute into town or towards Motherwell?   • Sorry to hear your troubles but glad you’ve bought somewhere. Each time I see a Lets Direct (often around moss side road) they have the same cheap-ass black plastic upholstered dining furniture and black faux leather suite. As someone who previously rented, any time I see furniture like that I think “landlord is probably cheap/tax dodging/crook” - avoid. And each time it is a Let’s Direct property.   • Shawlands has lots of small shops and bars, gym and stuff, and great transport into town, plus the park. Can be a bit busy/grubby at times along Kilmarnock Rd tho, but not bad. I like Mt Florida, a bit quieter, as is Cathcart, plus there are some great takeaways along battlefield. Crosshill I didn’t mind when I lived there, but is kind of swallowed by the bad rep of Govanhill, tho I haven’t been there for a while. No one in Shawlands/Mt Florida/Cathcart will care about your pink hair. There’s a college in Battlefield so there’s a mild creative/studenty vibe around there anyway.   • Maybe worth a small claims (or simple procedure whatever it’s called now) if you can somehow claim negligence? £3k excess wow that is shocking. I have £350 excess and after 4 leaks in 18months am taking GHA to small claims for the most recent one.   • You have to at least ask them to pay before going to the simple procedure route - and you have to have paid for the repair already so you can prove to the court you are out of pocket due to their actions. Eg show bank statements etc for the repairs. Then write to the neighbour asking for payment in 30 days, or else you will raise the simple procedure.   • Downstairs Shop need to claim from their (communal or own) buildings insurance for repair of damage within their property. They may have to pay the 'escape of water' excess themselves too (it's £350 on my tenement block policy). Maybe they'll try to ask you to pay the excess, but that is not your responsibility. If they don't have escape of water on their own insurance, that's their problem. You told them the leak has been repaired - that's all you need to do. When Shop informs their insurer, they will be asked if the leak has been resolved before they'll consider paying for a repair, and you've advised all parties it has been resolved, so you have nothing else to be responsible for. Even informing the factor was maybe even not required, but probably good sense to let them know. Regarding any liability claim that the Shop might want to pursue against you (maybe they don't have escape of water coverage, but I'd be surprised) they would have to prove negligence on your part, which is not going to happen. For context, I have had to pay this excess 4 times in 18 months (£1400!) because the property upstairs has flooded me, and there's nothing I can claim against them because I cannot prove negligence.   • Good luck hope it works out! The flat upstairs is owned by a Housing Association and their tenant is let's say irresponsible, but the HA continually dispute their liability and just point to normal wear and tear for each leak - sometimes it's the bath, then it's the shower, then it's the WC etc. For the most recent leak I've raised a public liability claim with the HA as I had to get an emergency plumber to fix their leak (they wouldn't send an emergency plumber to their own property despite water streaming through my light sockets etc) and so I've also claimed for the £350 insurance excess, given in this instance I think they were negligent in not getting a plumber. It's currently with their lawyers as I've advised them I'll make a small claims via the Simple Procedure (you have to try all other avenues before the court will entertain a Simple Procedure).   • If you must park outside, buy a lock that is more expensive than your bike and park it somewhere that if an angle grinder was used, the thief would likely be disturbed. I have a 5kg kryptonite New York fahgettaboudit chain, which is difficult to grind thru. Fran Healy, cousin of a friend's friend - met at a random party in EK I think. Interested in whatever you're doing or talking about, seemed genuinely nice person. Ally McCoist, bumped into him running through Burnside, late 1980s so was probably training. Stopped to at least say hello to some wee daft lads. Sanjeev Kohli, also likeable. Met him at the audience recording for that coach trip sitcom he co-wrote? It wasn't funny, but he was very personable. James McAvoy, met in the Old Dairy pub in Finsbury Park at the bar, politely waiting his turn like us plebs. Peter Capaldi at the Sainsburys petrol station in Green Lanes. Waited his turn behind me whilst I paid. Wore a beanie pulled down to his eyebrows as disguise. Drove (I think) a silver Micra? Billy Boyd at an old style fish restaurant in Brighton, more than happy to have his photo with a wee guy (8-9) who was with one of our group. Couldn't have been more pleasant, despite interruption to his cod and chips! The lead guy or whoever is second in command from Camera Obscura, what an absolute wank, at a TITP battle of the bands at King Tuts.   • This is for your landlord, not you, to pay - unless factor fees / communal costs are part of your rental contract (which seems v unlikely). Am a LL of a tenement flat, and paying the communal repairs of this nature is part of my responsibility. I don't expect my tenant to pay communal costs.   • Yes tenants would have contents insurance to cover their personal belongings, and the flat's owner/landlord would have buildings insurance at least, and possibly also contents insurance, if the flat was part/furnished by them. e.g. If the flat gets flooded, the landlord will claim his buildings insurance to repair the damage, and his contents insurance e.g. to replace the sofa - but you would have to claim from your contents insurance if your computer or music equipment got damaged. by happyfeet2039 (Tue 28th Sep 2021 2:48pm)
  • Sorry that sounds like you should maybe phone Living Rent, or maybe Shelter(?) for some advice. He might have a 'block policy' that would cover each individual dwelling under one policy, but then he should be paying (I think) 5 individual premiums for each dwelling covered by that policy, which he probably isn't but he may be. However, if he has not told the Planning dept that the building is converted, it's likely any building insurance - whether block or individual - would not be valid, as how could the insurance company know that the building is wind/watertight before accepting his custom, if he's done an unapproved cut-and-shut conversion. Good luck, there are some decent LLs out there, but yours does not sound like one. If the property is not liveable for you, and you have a legit tenancy agreement(?) then I understand you may have rights to move to alternative accommodation which your LL will be liable to pay - but how you get him to pay e.g. an AirBNB or hotel, that would be another challenge. by happyfeet2039 (Wed 29th Sep 2021 8:51am)
  • Sorry to hear, but you are not alone. One tip from me - keep good records of all your issues/contact with them. I had difficulties with one of their tenants, and their repair services. When I made an FOI request to get info on when they knew about leaks/issues from one of their flats, Lowther / Wheatley Group told me their maintenance systems did not keep date/times of calls made to their emergency repair services, or times when their staff attended their properties. What utter horseshit. I had to escalate to their data controller, who said they'd made a mistake - the date/time was there, "it was just in a hidden column in Excel". I made a public liability claim against them (prior to taking them to the Sheriff Court), I provided them with the times of incidents *from their own system* with my claim, and they said they rejected my claim because they did not have info on the times of incidents. It was in the same f@cking letter, they just pretended they could not see it. These are the kinds of c&nts you are dealing with unfortunately.   • Fly in/out couple times a month. Departures have been fine. Arrivals queues are a bit of a joke, with 9(!) desks, usually only manned by 2 border patrol guards, yet they funnel 99% of all passengers to 4 or 5 automated gates.   • Once you get upstairs to stop the leak you’ll need to get on to your landlord to claim from their building insurance to repair the damage in your flat. If it’s a tenement they probably have a block policy. You shouldn’t have to do anything yourself/pay anything for the repairs.   • Is cheaper because there are less amenities for younger folk, with mostly families and an ageing population. Will not compete with Shawlands for cafes/bars etc., but has a couple of local ones and a number of pubs of varying quality. Definitely caters for a bit of an older demographic, though some new places are slowly opening up, and getting recognition. (Milo's bakery) Arcade is a bit low-end, but which ones aren't. Quick transport into town, or to Motherwell, or buses to EK. Is a little bit rough round the edges at times, but the roads around Wardlaw Drive/Hamilton Road/etc. are a quiet pocket, with light traffic and would be ok for bringing up a family. Overtoun park is ok, but not a patch on Queens Park or Pollok Park. If you drive, Cathkin Braes/countryside is 10 mins.   • I have a tenant and although the standard lease says no pets unless agreed, I know the tenant got a cat at some point without asking. But really it’s a family apartment and if the cat is part of their family then I am not using it as a reason to evict them. Your mileage may vary as landlords can be dicks.   • This flat used to be short-term letted for "business visitors" if I remember - so it's done up to be a turn-key let. But where's the washing machine? Must be short-term, and they just do the AST tenancy paperwork every couple of months.
