  • Have you tried that mybuilder website? I used it to get a new boiler fitted. You essentially post your job up, you can put photos up as well. Then you can shortlist 5 tradies who get back to you, they get your number and they come out. It's got a review system like TripAdvisor so this might make them more keen to do the job, or at least not ghost you. Although it's called mybuilder it covers all sorts of tradesmen.   • Hello, I am a police officer. Unfortunately you are in a pretty difficult position. In terms of throwing this person out because your family member no longer wishes them to be there, there is absolutely nothing the police can do. This would be a civil matter meaning you should approach a solicitor or go to the citizens advice service, to establish what the steps are. However given that you state the person is being abusive etc, you could contact the police and report his conduct, for example assaults, or threatening and abusive behaviour, if he obviously has capacity ie doesn't have a mental health problem this could lead to him being arrested and being given conditions not to approach the property. However, you state this person is suffering from mental health problems, and you believe possibly that their behaviour is being driven by this? This would clearly complicate the above and in these circumstances it may not be straightforward. I would suggest you do the following: Contact the police via 101 about your concerns, do not tell the police simply that there is a family member refusing to leave as that is not a police matter and they will not attend or speak to you further. Obviously make mention about your concerns regarding the persons behaviour. If there is no real violence or threat of violence the police may not do alot, however if there are clear mental health concerns they will make a referral to adult protection social work. Contact a solicitor, you should be able to get at least a free telephone consultation, I think? You can search for a solicitor by looking at the law society of Scotland's website. I would suggest contacting, adult protection social work, the person's GP and any other professionals who are involved with this person's mental health and see if some sort of plan can be put in place about rehoming him or getting him diagnosed with some sort of personality disorder. A mental health officer could get a warrant to remove the person and take him to hospital for assessment, the police cannot do this unless the person is in a public place. I am not going to pretend that this will be particularly easy to sort out, it wont, and most agencies will simply palm you off unless this person is literally bleaching your family member. Unfortunatly this kind of behaviour sometimes falls in between the cracks of the criminal justice and mental health systems. You will just have to torture the above agencies until something gets sorted out, including phoning the police anytime there is anything which could be construed as threatening or abusive behaviour. I would also suggest you post on legal advice uk, making clear that you are in scotland for advice also. by theresthepolis (Wed 29th Jul 2020 8:05pm)
  • This is to my understanding the legislation a doctor within a hospital uses to detain someone for 72 hours after they have been detained, on a short term basis by police or ambulance or whatever. I believe it is s34 of the Mental Health (care and welfare) (scotland) Act 2003 which sets out the need for warrants, to enter (not necessary in this case) but then to also remove a person for assessment. The police may be able to take a carrot/stick approach using a bit of verbal judo to entice the person to go to hospital of their own accord, but strictly speaking they could refuse, and then you are back to a civil matter. by theresthepolis (Thu 30th Jul 2020 4:09pm)
  • Yes if someone is detained and absconds then the police will of course return them no powers are needed as they are enforcing the EDC. If there was a serious threat of self harm suicide or harm to another then the police could use common law powers, to remove someone.   • Yeah the other the other thing you have to consider is the amount of pressure people are possibly putting on the police to do something about it. "Like that van full of junkies is parked outside my flat and youse are doing fuck all about it" then they contact MPs MSPs, lawyers, make complaints against the police.   • Do you live alone? If you're with another adult or can get one of your neighbours to act as a witness, next time he does anything criminal phone the police. If theres at least two of you that give statements he'll be arrested and charged, and probably get held custody to appear at court next day. As its a neighbour dispute, he should ideally get released on bail not to enter your street or close. Just tell the polis the background, continuous offending, explain there are community tensions due to his behaviour and you believe bad boy is himself at risk of retribution etc. Given he's a radge junkie he'll probably breach bailat which point phone the polis and he'll hopefully get remanded. Then onto to council/landlords to get him to fuck. You could also look at a wee cctv camera covering your front door. I mean I get you don't want to be a grass, but I think most people even in areas which aren't particularly pro polis would udner stand that if some cunt is kicking your door at all times etc phoning the police is reasonable. by theresthepolis (Mon 2nd Nov 2020 3:55pm)

  • Sorry for the late reply mate. I went through one of those sites, think it was mybuilder.com and a self employed guy came out and he just went up on a ladder. Think the problem is the companies need to adhere to H and S legislation and would be crucified if someone fell and injured themselves. Difficult to deal with however due drivers not wanting to get involved, if they even remember who they gave it to and the lack of corroboration.   • Like what? Basically every large scale protest since the beginning of covid has been allowed to go ahead, including BLM. Given the Govan riots etc there is a real risk of sustained public disorder if the event was over policed. Perhaps they will identify organisers to subsequently be arrested and prosecuted, though I imagine an event like this has probably happened organically without any ringleaders.   • To some extent probably, well ok not actually but in general as far as I'm aware, in Victorian times the West end of UK cities were predominantly the wealthy parts. Due to prevailing winds in the UK going west to east, this caused pollution from factories to be normally blown over the east of cities.   • I mean, I'm assuming the logistics of detaining people at their house and taking them directly to an airport for a longhaul flight are pretty impossible. People are going to have to be in some form of detention centre at some point. I agree such a place should not be for profit. Though it should be said the Scottish government operates for profit prisons such as HMP Kilmarnock and people are put there awaiting trial regularly. The police right now will be reviewing all the cctv from george square, the media and social media footage and the footage they themselves have recorded. The ones engaged in disorder will be prosecuted where identified. Being involved in any disorder at all in something like this will involve being reported to the PF. Having watched the social media footage it is incredible how many are engaging in violent disorder without being masked up, many will be well known to the police, particularly the officers who deal with rangers risk support.   • Yeah if you look at the legislation I linked, it specifically criminalises playing music, singing etc and doesn't cover other noises, we often go out to people complaining about banging, moving furniture at night, there is no ability for the police to deal with this kinda stuff.   • The orange order isn't a scottish institution, its an Irish protestant one primarily, scotland is just one of many overseas chapters essentially. There was a great bbc article about the orange order in an African country, strangely according to the article if I remember correctly the locals created it themselves after hearing about the orange order, as a way of affirming their protestantism, it wasn't like an orange lodge set up for white colonisers which the locals continued after independence or anything.   • Yeah, I guess its difficult for BTP to manage its officers in the same way a normal police force could due to the massive geography it covers relative to its size, and the impossible commutes it would create for its officers if it suddenly told them they were being redeployed to Glasgow.   • Aye but what if the ambulance is stuck in traffic streets away due to the protest. Yes they have blue lights, but there's only so much they can do in a solid traffic jam. I know this was a major issue in London during one of their protests, when they blocked bridges across the Thames.   • I think the idea that capitalism is some sort of zero sum is an odd one. You could easily live in a capitalist economy with state run services such as health care or railways etc etc. Only those on the hard right would argue otherwise. Many places with extreme poverty like in Africa etc, are not really capitalist economies as they don't really have free markets due to corruption and lack of rule of law. And whilst not everyone in the UK has food and physical security a huge majority do and quality of life is much better in the era we live in than any other time in human history.   • The only problem comes if it goes wrong you hit a pedestrian etc. You will be proper fucked, driving an unregistered vehicle, no insurance, if you have a driving licence you are looking at serious points, potentially even losing it.   • You are correct, I am a police officer and it's not illegal to have something like a baseball bat in your house for the express purpose of defending yourself. There is no legislation outlawing this. You have to show you used it reasonably, which in a break in situation will usually be a pretty forgiving definition. However in basically all circumstances if you seriously injure someone, IE knock them unconscious, give them a permanent disfigurement, disability, or kill them, you will be arrested and interviewed under caution. You now essentially have to be arrested in Scotland in order to be interviewed under caution, as this is the only way to get ensure you can receive free legal advice from a lawyer, which you will always want in this situation. It's an investigatory means for the police to ask you for your account, on the record, of what happened, after you have had the option of free legal advice. As well as confirming your identify and being able to take DNA and fingerprints from you. Whilst it might seem obvious, the police can't always just assume what has happened has been a housebreaking. I know nothing of this case but if you seriously injure someone regardless of the circumstances, outside of maybe taking down a terrorist in broad daylight, you will be arrested and questioned about it. An arrest is not a punishment. The police have to investigate all serious injuries/death.
